1.Use of TransportPlaza.eu

These Terms of Use set forth the legally binding terms for your visits and uses of the TransportPlaza.eu site and its related services (the “Terms of Use”). Use of TransportPlaza.eu is also governed by our privacy policy and our copyright statement which are incorporated into the Terms of Use by this reference. By visiting or using TransportPlaza.eu, you agree to be bound by the Terms of Use, whether you are a Visitor (which means that you simply browse the TransportPlaza.eu site) or a Member (which means that you have registered with TransportPlaza.eu). 2. Applicable Law and Jurisdiction

All legal issues, disputes and litigation matters relating to or resulting from the (lack of) access to, the visit of and the (illegal or prohibited) use of TransportPlaza.eu are governed by Belgian law.
The Courts of Brussels shall have exclusive jurisdiction over any dispute relating thereto, without prejudice to Teleroute making choice of any other court having jurisdiction on such a dispute under any applicable law. The use of TransportPlaza.eu is not allowed in countries where the totality or a substantial part of the Terms of Use, including this paragraph, is not applicable.

3. Restricted Use

All references in the Terms of Use and in the privacy policy relating to TransportPlaza.eu shall mean, without any exception, a reference to Teleroute NV and/or any of its affiliates and subsidiaries or companies in the group to which Teleroute belongs.
You are not authorised to change, copy, distribute, send, circulate, re-offer, reproduce, publish, license, transfer or sell any information, software, products or services obtained from this website or to create derived works, products and/or services from the aforementioned elements.
1.TransportPlaza.eu grants you the permission to add surface links to the TransportPlaza.eu homepage. However, the written consent of TransportPlaza.eu is necessary for each deep link, frame or automatic link.
Each User recognizes that the Terms of Use and each participation in or use of the TransportPlaza.eu website do not result in the creation of a joint venture, trade association by way of participation, relationship of employer-employee, power of attorney or any other type of cooperative or commercial venture between the User and TransportPlaza.eu.

4. Code of conduct and use of the Communities

4.1. TransportPlaza.eu website contains discussion groups, information groups, forums, communities and/or other messaging or communication systems (brought together under the name "Communities" or, separately, a “Community”) between Members. You agree to use the Communities exclusively to send and receive reports and information that are specific or related to the Community in question. In using a Community you agree at least to respect the following list of rules, without them being exhaustive:
1. not to insult, mistreat, stalk, aggravate or threaten anyone, nor to violate the rights of others (especially the rights of the individual, including the right to a private life,) in any way.
2. not to publish, submit, upload to a server, distribute or circulate any topic or element, name or information that is inappropriate, offensive to religious or ethical convictions, racial, libelous, obscene, immoral, unauthorised or that violates any right whatsoever, especially intellectual property rights.
3. not to upload files to a server that contain software or other elements that are protected by intellectual property rights (or by the rights of the individual, including the right to a private life), unless you are a holder of the aforementioned rights, exercise legal control over these rights, or have obtained all the required authorisations.
4. not to upload files to a server that contain viruses, corrupt files or any other comparable software or programs that can impair the operation of another computer.
5. not to participate in or send studies, contests, pyramid systems or chain letters.
6. not to send or post unsolicited messages (‘spam’) to other registered members
7. not to download files that were sent by a user of another Community when you know (or should know) that this distribution is illegal or violates its confidential nature.
8. to make public confidential information or business secrets.
9. not to remove or falsify any statement contained in a file that is uploaded to a server that concerns the author, a legal statement, or any other indication of rights of ownership or that concerns the origin of the source of the software or any other element.
10. not to limit or hinder the use of the Communities by any other user. You acknowledge that all Communities consist of public messages and not of private messages. Therefore, your messages can be read by other registered members without you being notified of this. Always be very careful when communicating any personal identification data concerning yourself or your children in a Community.

4.2. Content

1.TransportPlaza.eu exercises no control nor in any way approves the content, the messages or the information that is encountered in a Community, and consequently TransportPlaza.eu specifically refuses to accept any liability concerning the Communities or any legal claim that results from your participation in a Community. In accordance with Articles 18 to 20 of the Belgian Act of 11 March 2003 on certain legal aspects of information society services TransportPlaza.eu cannot be held liable for any transmitted information.
TransportPlaza.eu does not claim any ownership rights in the texts, files or any material (the “Content”) that you post on TransportPlaza.eu. By displaying or publishing any Content on or through TransportPlaza.eu you hereby authorize TransportPlaza.eu to use, modify, publicly perform, publicly display, reproduce and distribute such Content on TransportPlaza.eu and through the services related to TransportPlaza.eu.
This authorization is not exclusive (meaning you are free to authorize anyone else in addition to TransportPlaza.eu to use your Content), free of any charge towards TransportPlaza.eu, extendable to affiliates and partners of TransportPlaza.eu and worldwide.

4.4. Use of Publicity in the Communities

Apart from the general rules of conduct relating to the use of the Communities or of a Community, publicity send to other Members should comply with the rules established by the EU Directive 2002/58/EC on privacy and electronic communications, and in particular with the following rules:
•Publicity and/or direct marketing should be solicited by Members and may not fall under ‘spam’ messages.
•The right to oppose to future publicity should be mentioned and the means to use this right should be accessible, unambiguous and clear.
•It is prohibited to use the e-mail address or identity of third parties for direct marketing purposes.
•It is prohibited to delete the origin or the (initial) author of the mail in order to use the right to block future publicity.

5. Restriction of Access and Reporting of Irregular Use and Contact Details

TransportPlaza.eu retains the right to deny access to these Communities or all Communities at any time and for an indefinite period, without notification and for whatever reason.
In addition, TransportPlaza.eu retains the right to distribute any information in order to comply with all applicable laws or regulations, or to comply with a judicial or administrative order.
TransportPlaza.eu asks its Members to report any unauthorised content that might be accessible via its services in order that TransportPlaza.eu can take the required and appropriate measures to delete this information or make it inaccessible. 6. Unauthorised or Prohibited Use

You may use TransportPLaza.eu only on the condition that you guarantee TransportPlaza.eu that you will not use this website for unauthorised purposes or goals, nor for violating the Terms of Use, the law or any other legal and/or contractual provision of TransportPlaza.eu .
It is prohibited to use the services of TransportPlaza.eu for any transaction that results in:

Subject to general and particular criminal rules in another jurisdiction applicable due to the place where a user or registered member is located, TransportPlaza.eu particularly warns you for the following Criminal Offences for IT abuse under Belgian law (Articles 210bis, 504quater, 550 bis and 550 ter Belgian Criminal Code):
Each person who submits (saved, processed and/or transmitted) data from an IT system to another database or IT system in order to modify, erase or change the data using technological means, and each person who uses such data knowing its origin or the illegal submission and/or fraudulently acquires a benefit or asset using these data, commits an act of fraud and may be held liable for this criminal offence.
A person can also be held criminally liable for Cracking or Hacking, i.e. obtaining illegally access and/or intentionally bypassing the regular access entry to a protected website or a part thereof, and Data manipulation, i.e. directly or indirectly inserting, modifying, deleting or changing data by using technological means.
Attempting these criminal offences is also criminally sanctioned. TransportPlaza.eu explicitly retains all rights to report Members who violate Belgian or international law to the competent authorities and to suspend access to and use of the services and databases for an indefinite period of any Member who violates the present Terms of Use.

7. Limitation of Liability

The information, products and services included in this website can contain technical and content-related inaccuracies or typing errors. This information is subject to periodic change. TransportPlaza.eu and/or suppliers can make improvements and/or changes to this website at any time. Take no decision of a personal, medical, legal or financial nature based on the opinions received via this website.
